    BERSIH 2.0: SUHAKAM Enquiry into Police Brutality

    BERSIH 2.0: Keterangan saksi untuk kes-kes keganasan polis pada 9 Julai

    Suruhanjaya Hak Asasi Manusia Malaysia (SUHAKAM) telah mengumumkan bahawa pihak SUHAKAM akan menjalankan siasatan awam mengenai, antara lain, dakwaan penggunaan kekerasan melampau ketika Perhimpunan BERSIH 2.0 pada 9 Julai.

    BERSIH 2.0 dan SUARAM sedang mengumpul kes dan bukti mengenai penggunaan kuasa melampau oleh polis daripada peserta Perhimpunan BERSIH 2.0 untuk siasatan awam SUHAKAM. Adalah penting untuk orang ramai memberitahu pengalaman mereka supaya ketidakadilan dan penyalahgunaan kuasa didedahkan.

    Berikut merupakan kes-kes dan bukti yang kami sedang mengumpul:

    1. Kes-kes keganasan polis

    BERSIH 2.0 dan SUARAM menyeru kepada semua peserta Perhimpunan BERSIH 2.0 untuk memberi maklumat kepada kami sekiranya anda telah mengalami layanan berikut daripada pihak polis pada 9 Julai:

    a) Penderaan fizikal (Contoh: Dipukul, ditendang, ditampar, dipukul menggunakan baton dan lain-lain)
    b) Penderaan melalui kata-kata kesat
    c) Ditangkap dan ditahan

    Mangsa kekerasan polis boleh memberi maklumat kepada kami dengan mengisi borang yang dilampirkan.

    Setelah borang tersebut dilengkapkan, hantar dalam emel kepada info@bersih.org dengan tajuk emel

    9 Julai Kekerasan Polis,

    atau faks kepada 03-7784 4978 *sebelum 3 Ogos 2011*.

    2. Gambar-gambar dan video kekerasan polis

    Pihak polis telah mendedahkan gambar-gambar yang dipilih dengan hati-hati untuk memburukkan Perhimpunan BERSIH 2.0. BERSIH 2.0 dan SUARAM juga sedang mengumpul bukti-bukti gambar dan video.

    Kami sedang mengumpul gambar-gambar dan video kejadian-kejadian berikut:

    a) Keadaan ketika kematian Arwah Baharuddin Ahmad
    b) Penangkapan Muhammad Sabu
    c) Serangan polis yang tidak berpatutan di terowong KL Sentral
    d) Tangkapan dan layanan ganas oleh pegawai polis
    e) Tembakan air asid dan gas pemedih mata ke dalam Hospital Tung Shin

    Tolong hantar sebarang gambar dan video yang boleh dijadikan bukti kepada info@bersih.org *sebelum 3 Ogos 2011*.

    Kami menghargai semua yang berkongsi maklumat yang kredibel dengan kita. Tolong sebarkan perkara ini kepada semua rakan-rakan dan ahli keluarga yang menyertai Perhimpunan BERSIH 2.0 pada 9 Julai.

    The Human Rights Commission of Malaysia (SUHAKAM) has announced that they will be holding a public inquiry into allegations of, amongst others, excessive use of force during the Perhimpunan BERSIH 2.0 on 9 July 2011.

    BERSIH 2.0 and SUARAM are collecting cases and evidence of excessive use of force by the police from participants of Perhimpunan BERSIH 2.0 for the SUHAKAM public inquiry. It is important that people share their experiences so that the injustice and abuse of power is exposed and those responsible are held accountable.

    The following are the cases and evidence we are collecting:

    1. Cases of police brutality

    BERSIH 2.0 and SUARAM call on all participants of Perhimpunan BERSIH 2.0 to provide information to us if you have experienced the following treatment by the police on 9 July:

    a) Physical abuse (e.g. beating, kicking, slapping, hit using baton or others)
    b) Verbal abuse
    c) Arrest and detention

    Victims of police abuse can provide us information by filling in the attached form.

    2. Photographs and videos of police abuse

    The police have revealed their own carefully selected images to demonise the rally. BERSIH 2.0 and SUARAM are also compiling our own video and photo evidence.

    We are compiling photos and videos of the following incidents:

    a) The circumstances surrounding the death of Baharuddin Ahmad
    b) The arrest of Muhammad Sabu
    c) Unwarranted police attacks at the KL Sentral underpass
    d) Violent abuse and arrest by police
    e) Shooting of water cannon and teargas into Tung Shin Hospital

    Bersih supporters take aim at police ‘weaponry’

    KUALA LUMPUR, Aug 5 — Bersih 2.0 supporters have accused the police of “clear intent” to cause injury or even death during its July 9 rally given the “lethal” levels of tear gas and chemicals in the water cannons used to disperse tens of thousands who poured into the capital last month.

    They told the Human Rights Commission (Suhakam) today that the inquiry into claims of police brutality must “investigate why the police is using such dangerous products that have a track record of causing death.”

    “These canisters state clearly that they can cause serious injury and death. The US-based Federal Laboratories supplies the tear gas to the Israeli army and have been sued by Palestinians who lost family members,” Fadiah Nadwa Fikri from Lawyers for Liberty said today.

    She also told The Malaysian Insider that tear gas produced by Federal Laboratories has been banned in several countries and this “raised questions over why the police are using such weaponry.”

    Tenaganita chief Irene Fernandez also told the commission that “police knew exactly what they were doing as they already had the tear gas and chemicals ready. There was clear intent to cause harm; that is what is worrying.”

    Opposition leaders and human rights activists have repeatedly claimed that police used excessive and brutal force in dealing with the July 9 rally for free and fair elections, arresting nearly 1,700 on the day, leaving scores injured and one ex-soldier dead.

    PKR also previously claimed that police had fired tear gas canisters directly at Opposition Leader Datuk Seri Anwar Ibrahim, an act they want classified as attempted murder.

    But police have formed six committees of their own to investigate whether the force had acted improperly after locking down the capital from the night before the rally.

    The police recently released videos that appeared to absolve the force of blame and show that riot police were provoked by the demonstrators.

    Suhakam was receiving testimonies today from the coalition of 62 non-governmental organisations ahead of a public inquiry that commissioner James Nayagam said would likely be held after Ramadan.
