    KUALA LUMPUR, Aug 27 — Felda will take action against a legal firm which was involved in its suit against 354 settlers at Felda Kemahang 3 in Kelantan.


    Minister in the Prime Minister’s Department Datuk Ahmad Maslan said Felda was currently studying suitable action to be taken against the firm which had caused the agency to lose its suit against the settlers.

    “The absence of the lawyer during the hearing due to technical reasons were very much regretted and has tarnished Felda’s good name,” he said in a statement to the media after the Umno Supreme Council meeting here today.

    Yesterday, the Federal Court dismissed Felda’s application to review its ruling which denied the agency leave to appeal against the Kota Baharu High Court’s decision on Jan 13, 2008.

    With the decision, Felda will now have to pay RM11 million in general damages and interest to the settlers.

    Ahmad said it was feared the case would be misinterpreted by other settlers as the agency was now facing two other charges for manipulating oil palm grading filed by the settlers in Felda Maokil, Pagoh and Felda Gugusan Raja Alias in Negeri Sembilan.

    “I would like to stress that the Federal Court ruling was not due to fraud or conspiracy committed by Felda as alleged by certain quarters,” he said.

    Ahmad said every transaction was made in a transparent manner and the sales and purchase receipts were given to each Felda settler who sold the oil palm yield to the Felda factory.

    “If they don’t agree with what was stated in the receipt, they should bring it up to the factory immediately, and not make a compilation of fraud allegations over a long period of time,” he said.

    Hence, he also reminded the settlers not to be influenced by any quarters, especially those with personal interests, to file a legal suit against Felda. — Bernama TheMalaysiaInsider....

    LAPORAN KHAS GEMAS: Menjengah ke tanah rancangan Felda Palong 9 pula, FMT menemui peneroka yang disingkirkan dua kali selepas dikatakan melanggar Surat Aku Janji Peneroka.

    Che Hasyim Che Long,46, disingkirkan buat pertama kali pada Oktober 2000 kerana didakwa melanggar Seksyen 22 (1) GSA atas kesalahan tidak bermastautin bersama keluarga didalam tanah rancangan.

    Namun Che Hasyim mempunyai alasan tersendiri kerana pada ketika itu, beliau mendakwa mengalami masalah keluarga apabila terpaksa membawa isterinya yang sakit berubat di Kelantan.

    Sepanjang peninggalannya, beliau hanya menjengah ke Palong sebulan sekali dan kebun getah asal seluas 10 ekar bernombor Lot 7259 yang perlu diusahakannya tidak dijaga dengan baik.

    Mengakui kesilapannya, Che Hasyim membuat rayuan untuk kembali semula sebagai peneroka pada awal tahun 2006 dan kemudiannya diterima oleh pihak pengurusan pada Oktober 2006.

    Akan tetapi apa yang menghairankan, beliau mendapati kebun getahnya masih mempunyai rekod pengeluaran hasil di luar pengetahuannya sepanjang tahun 2000 hingga 2006.

    Berikutan itu, beliau mengemukakan rayuan untuk menyemak semula rekod pengeluaran hasil dan mengemukakan tuntutan pembayaran hasil yang tidak diperolehinya sepanjang enam tahun tersebut berjumlah RM400,00.

    "Sejak itu, saya dan keluarga menerima tekanan daripada pihak pengurusan supaya membatalkan niat saya untuk menyemak rekod dan menuntut pembayaran tersebut sehingga tercetusnya pergaduhan antara anak lelaki saya dengan pengurus Felda Palong 9 pada 7 Mac lalu," katanya.

    Disingkir lagi

    Disebabkan insiden itu, beliau sekali lagi didatangi surat penyingkiran dan diberi tempoh seminggu untuk keluar daripada tanah rancangan berkuat kuasa 13 April lalu.

    "Saya keliru kenapa saya disingkirkan kerana surat tersebut tidak mempunyai kepala surat (letterhead) tanpa nama dan jawatan individu khas pegawai pengurus yang menandatangani kelulusan surat tersebut.

    "Surat itu juga tidak memberi alasan yang munasabah serta tempoh untuk saya mengemukakan surat tunjuk sebab, malah kes anak saya masih lagi dalam perbicaraan mahkamah, jadi mereka tidak boleh tuduh anak saya bersalah selagi mahkamah belum memutuskannya," katanya.

    Berikutan itu juga, beliau juga dilarang mengutip dan menjual hasil kebun getahnya kepada Felda sekaligus punca pendapatan untuk menyara 9 orang anaknya terjejas.

    Ketika ini, Che Hasyim telah pun mengemukakan beberapa laporan polis serta mendapatkan bantuan guaman menuntut keadilan daripada pihak pengurusan Felda.

    "Saya dianiaya. Banyak berlaku salah faham dan tekanan yang saya hadapi. Mereka dakwa saya melakukan pelbagai kesalahan dan gangguan ditanah rancangan sejak tahun 2006, tetapi saya tidak pernah menerima surat penjelasan secara hitam putih daripada pengurusan jika benar saya melakukan kesalahan yang dinyatakan," katanya.     Another Orang Asli church construction in Kelantan is being stopped by the authorities, this time by the Department of Orang Asli Affairs (JHEOA)

    They had issued a stop-work order to the Temiar village of Pos Pasik, Kelantan, as no permission had been granted to build a church there (left).

    In the earlier 2007 incident, the Gua Musang local authority had ordered a halt to an Orang Asli church construction, only to be met with court action by the community for unlawfully demolishing their church.

    In the case of the Temiar village, the department's deputy director-general Nisra Nisran Asra Ramlan in a letter dated Aug 9, had said that an application to build a church at that location had been rejected and ordered an immediate stop to all construction work.

    The letter was in reply to village head Setmen Belungei who on May 20 had written to the JHEOA informing them of their plans for a church there to replace their exisiting one made of bamboo (right).


    Half of the villagers had converted to Christianity in recent years.

    Orang Asli bare fangs through counsel

    However, the Centre for Orang Asli Concerns coordinator Colin Nicholas said that the department's permission was never sought and that the earlier letter was only a notification.

    "The Orang Asli are not happy with this answer as they did not seek permission from the JHEOA," he said.

    They had merely exercised courtesy to inform them of their plans.

    The Orang Asli of Pos Pasik consider it their right to build such a structure on their land, in accordance with the constitution, he added.

    Colin (left) said that lawyer Lum Chee Seng representing the Temiar headman had written to the DG on Sept 13 informing him that the department's permission was not being sought.

    "He also sought the reasons for the rejection of the church building," he said.

    In 2007, the Gua Musang district land office had issued a 'stop work' order to the Orang Asli church construction in that area as it was state land and no prior permission had been sought.

    However, this was rebutted by the National Evangelical Christian Fellowship of Malaysia which pointed out to the land office that the site belonged to the villagers.

    In spite of this, another 'stop-work' order was issued on April 19, followed by a notice of demolition dated May 24. The bulldozers arrived on June 4.

    On July 1, 2007 village head Pedik Busu and three villagers filed a case against the Gua Musang District Council head, the Gua Musang Assistant Land and District Officer and the PAS-led state government.

    And in July 2009 the Kota Bharu High Court ruled the demolition as illegal.

    Justice Mohd Azlan Hashim ordered the local authority to pay damages and costs because it had acted unlawfully when carrying out the action without giving the required 30-day notice. Malaysiakini. Subscription required.

    SEREMBAN: Some 23 Felda settlers from the Raja Alias 2 scheme at Serting near here lodged a police report against the management for stopping them from cutting their rubber trees and selling the wood.

    Jempol PAS chief Abdul Rahman Ramli said the report was lodged at the Ayer Hitam police station, near Bahau.

    Abdul Rahman said initially the Felda management had given an approval letter for the 23 settlers to cut and sell the rubber woods on their own.

    "But the management asked the settlers to pay first whatever debt they owed to Felda and all of them paid up,” he told a press conference at the PAS head office here."



    But suddenly last week, the Felda Raja Alias management informed the 23 settlers that the approval letter is not valid anymore on instruction from the Felda headquarters in Kuala Lumpur

    "This sudden change shocked the settlers who feel that the Felda headquarters has no concrete reason to deny the settlers their rights,” said Abdul Rahman, who is the spokesman for the settlers.

    "This should not have happened in the first place. The settlers want to manage their rubber trees on their own without Felda's help.

    "They want to be independent but why is Felda interfering?

    "I urged Felda to give them back their rights,” Abdul Rahman said.


    A rubber tree reaches maturity after 20 to 25 years, after which the tree cannot produce latex.

    So the rubber trees have to be cut and the re-seeding needs to be done for the second round of replanting. Recent advances in furniture-making using rubber wood have made rubber trees a valuable commodity. So settlers would cut the rubber trees to sell the wood to the furniture-makers.

    Meanwhile, Negri Sembilan PAS opened a secretariat to handle Felda issues and appointed Abdul Rahman as its chief.

    SEREMBAN: Deputy Minister in the Prime Minister’s Department Ahmad Maslan continues to draw flak for statements perceived to be insulting to Felda settlers.



    Tampin PAS chief Zakaria Khalim, who is himself a Felda settler, has challenged him to “walk the talk” by releasing RM2.5 million from Felda’s Re-seed Fund to 109 settlers who had proven that they could handle money responsibly and manage their plantations effectively.

    Last week, the Malay tabloid Harian Metro quoted Ahmad as saying Felda would not reimburse settlers who had re-seeded their plantations for fear that they would misuse the funds by buying motorcycles and cars and repairing their houses.

    Zakaria claimed that 109 settlers at Bukit Rokan had been re-seeding their land for 13 years without Felda’s help although they, like Felda settlers everywhere, had been contributing monthly to the Re-seed Fund.

    Felda owes RM23,000 to each of the 109, according to Zakaria.

    “Theirs is a genuine case,” he said. “They have been re-seeding their land from money they make from the sale of rubber wood.

    "These settlers have proven that they can manage their land independently and have been producing rubber for many years. So, in their case, what is Ahmad going to say? Why is Felda still holding the

    RM2.5 million belonging to them?"

    To go by Ahmad’s condescending argument, as reported in Harian Metro, Felda should not hesitate to reimburse the Bukit Rokan settlers, he said.

    Zakaria also accused Felda and Risda of giving the 109 settlers the run-around every time they approached either of the authorities for their dues.

    (Felda is the Federal Land Development Authority and Risda is the Rubber Industry Smallholders Development Authority.)

    “When they approached the Felda management and demanded cash from the Re-seed Fund, Felda told them go and ask Risda,” Zakaria said. “When the same settlers approached Risda, Risda told them go and get the money from Felda.

    PETALING JAYA: Prime Minister Najib Tun Razak was today panned for calling critics of the Federal Land Development Authority (Felda) traitors.

    Tan Kee Kwong, the former deputy minister of land and cooperative development, said that it was Najib who ruined Malaysia's largest rural plantation scheme when he was the deputy prime minister.

    "You turned what was a very successful organisation into a financial nightmare. You are the traitor who has stolen the poor (Felda) settlers' money!" Tan said in an angry open letter to the premier.

    According to a Bernama report, Najib, who took over the agency in 2005, charged that those who thought that Felda was bankrupt were in fact traitors to the nation.

    Naib also said that if Felda were to sell its shares overnight, it would attain a revenue of over RM4.3 billion. This was not the first time Najib had referred to his detractors as 'traitors'.

    At the BN convention recently, he called opposition leaders "anti-national" and said that they were "bent on destroying the country".

    Interestingly, the RM4.3 revenue mentioned by Najib was the same figure used by Tan when he made his accusation against the prime minister in June.

    Tan said that Felda had only RM200 million in its cash reserves this year, or a RM4.3 billion drop from its reserves in 2004.

    The former deputy minister also attacked the Prime Minister's Department for announcing profits over its upcoming new headquarters, Menara Felda.

    'Submit to an independent audit'

    Deputy Minister in the Prime Minister's Department Ahmad Maslan said last month that the increase in real estate value over Menara Felda gave Felda a profit of RM300 million.

    Menara Felda is also oddly enough, located only kilometre away from Felda's current headquarters along Jalan Perumahan Gurney, near KLCC.

    Ahmad said that when Felda first bought the land, it was priced at RM930 per sq ft, and had risen to between RM1,400 to RM1,500 today, which translated to a total profit of RM300 million for Felda.

    "How did he come to this conclusion when the building is not even finished or sold?" asked Tan of the RM662 million project, which he said received a deposit of RM235 million prior to its construction.

    He also asked how the building was going to help Felda's poorer settlers, some of them who earned only RM500 a month each.

    Tan said that Felda had much to answer for, and dared Najib to subject the agency, as well as its 43 subsidiaries to an independent audit and release the results to the public. FreeMalaysiaToday....

    Salam. I read with great interest today papers about your comments. In it you were quoted that those who talk bad about Felda & called it bankrupt are to be regarded as traitors to the Nation.


    The sad truth is that after you took charge of Felda in 2005, you turned what was a very successful organisation into a financial nightmare. In fact you are the traitor who has stolen the poor peneroka's money.


    I am sure you know that for the next General Election, Felda schemes & their votes determine about 60 Federal Parliament Seats. From my feedback, many of the peneroka are boiling mad.


    They have been exploited & taken for a ride.

    If what you say is true & ALL the peneroka are so happy with the UMNO/BN government, why the sudden interest in the welfare of the peneroka,


    Why the many cash handouts?


    Please explain the following.


    1. In 2001, the cash reserves of Felda was RM4.5 billion with ZERO borrowing. Recently your Deputy Minister replied that the cash reserves has plunged to RM1.2 billion. This is despite the fact that for the past 3 years, the CPO price has been very high. If you have looked after Felda properly the cash reserves should now be at least RM8 billion.


    2. New Felda HQ in KLCC.

    Said to cost RM662 million, Explain how this six star building is going to help the poor peneroka, many of whom only get nett RM500 per month. Why a huge deposit of RM235 million paid even before construction started? Why the decision was made at a secret meeting in your DPM's office in Putrajaya without the knowledge or approval of the Felda board? Recently Ahmad Maslan said this is a very good investment as it has already made paper profit of RM300 million. Pray how did he come to this conclusion when the building is not even finished or sold!


    3. Felda Global Ventures.

    We know that Felda has invested at least RM3 billion on these projects. We also know that since day one it has been losing money, in fact it has lost RM300 million.

    Twin Rivers Project in USA, invested RM500 million

    Cattle rearing project invested RM600 million

    Since you say we are traitors, tell us in detail what has happened. The peneroka in Felda Keratong near Segamat are laughing, the imported cattle for the cattle project have to be kept in an air conditioned room 24 hours a day!

    4. Why the need to borrow from EPF?

    Before you started on Felda Global Ventures. Felda never borrowed from EPF. Is this borrowing secure? To all the EPF contributors beware, your money is used to finance many of these dubious schemes which Najib started


    5. Skim Tabung tanam semula

    In August this year I visited a Felda scheme near Kemaman. I talked to a peneroka who wants to sue Felda. He has been contributing to this fund for psat 17 years & has accumulated RM17,000. However when he replanted his old oil trees, he did not use the fund but used his own money instead. It has been 3 years now tried to get his OWN money back, but the Felda administration has refused so far.

    Wonder why, if Felda is so well run & cash rich why can't even pay this poor peneroka a paltry sum?

    6. Felda settlers to camp outside Felda HQ.

    In October this year, there was a report that many settlers were not happy with Felda for refusing to settle their replanting payments. So this case i quoted above is widespread & happening in many. many schemes round the country.

    7. Oil palm fruit sent to Mill

    In Felda Kemahang, Kelantan. Felda lost the case as it was proved that Felda was not paying the proper amount sent to mill. It was a landmark case. On appeal Felda lost the case. Soon after that you visited a scheme near Bahau. Instead of respecting the court's decision you made a silly remark like Felda will engage the best lawyers & fight all the remaining cases in court. Good for you, you will make more peneroka angry with you!

    1. Subject the whole of Felda to an independant audit & publish the findings.

    2. Felda has 43 subsidiaries: publish all their annual reports & subject them to an audit as well

    (Bernama) -- Former Negeri Sembilan menteri besar Tan Sri Mohd Isa Abdul Samad has been appointed chairman of the Federal Land Development Authority (Felda) effective Jan 1 next year, according to a statement from the Prime Minister's Office.

    Mohd Isa succeeds Tan Sri Dr Mohd Yusof Noor who has been appointed advisor to the minister in charge of Felda, also effective Jan 1, 2011.

    For 23 intrepid settlers seeking justice, the court's verdict in their favour represents a big win.



    SEREMBAN: Some 23 Felda settlers scored a victory when the High Court here today set aside an injunction preventing them from clearing their own land without outside interference.

    High Court Judge Rosnaini Saub said in her verdict that she set aside the injunction filed by a sub-contractor as the settlers are the beneficial owners of the Felda land.

    Rosnaini also said the settlers of their respective plots have fully settled all outstanding amount owed to Felda.

    She added that Felda was supposed to return their plots to the state government so that the latter can issue individual titles to them.

    The 23 Felda settlers from the Felda Raja Alias 2 had challenged the injunction filed by the sub-contractor, Huat Hing Rubberwood Sdn Bhd.

    According to Surina Suhaimi, the lawyer for settlers, Felda had appointed Koperasi Serbaguna Felda Felda Serting Dua Bhd as its contractor for cutting down the rubber trees and clearing the land, including the plots cultivated by the settlers.

    “Koperasi Serbaguna then sub-contracted the job to Sheeco Sdn Bhd. Sheeco sub-contracted it to Huat Hing Rubberwood.

    “But the 23 Felda settlers wanted to appoint their own contractor to do the clearing,” she said.

    Lower price

    Huat Hing then filed the injunction and on Nov 30, 2010, the court granted it an interim order against the settlers.

    Thus, the settlers were prevented from interfering with the work of Huat Hing in clearing up the land.

    Speaking to reporters outside the court, Suhaimi Said, a PKR supreme council member and head of the PKR Felda bureau, said the ruling was a landmark victory for the Felda settlers.

    “Today is a big victory for them. Now they can appoint their own contractor and clear their own land. They can also do the re-seeding themselves without the interference of Felda or its sub-contractors,” he said.

    He said that the settlers had objected to Felda appointing the sub-contractor to cut the rubber trees , clear land and do the re-seeding because the price set by the Felda-appointed contractor was lower than the one offered by the contractor appointed by the settlers.

    “The price offered by the Felda-appointed contractor is only RM28,000 per seven acres compared with the RM35,000 offered by the settler-appointed contracter,” said Suhaimi.

    Similar predicament

    PKR Felda bureau secretary Rebin Birham urged more Felda settlers in a similar predicament to come forward and get justice from the court.

    “We in PKR are ready to help the settlers fight for justice. We want the settlers to get back whatever rights they have to their land. Felda is currently trying to deny them their rights by not following the rules spelt out in the Group Settlement Acts (GSA).

    “According to the GSA, Felda’s role is only to manage the land (rubber or oil palm) but the real beneficial owners of the land are the Felda settlers themselves,” Rebin said to applause from the 23 Felda settlers and their families.

    Rebin said that although the settlers today won their battle against the sub-contractor, it was in reality a victory against Felda because its appointed contractor was its proxy.

    “When the settlers want to appoint their own contractor to carry out the jobs, Felda refused to listen to them.

    “Instead, it went ahead and appointed its own contractor without bothering with the wishes of the settlers,” said Rebin.

    Previously, two groups of Felda settlers won their case respectively against Felda at Federal Court and Kuantan High Court last year.

    They are from Felda Kemahang 3 and Felda Sungai Koyan 2 and 3 respectively.

    Also present to lend the support for the Felda settlers today are Telok Kemang MP and Negri Sembilan PKR chief, Kamarul Baharin Abbas ; Sikamat PKR state assemblymen, Aminuddin Harun (PKR); Negri Sembilan PKR Youth chief, Mohd Nazree Mohd Yunus; and Jempol PAS chief, Abdul Rahman Ramli.     Prime Minister Najib Abdul Razak has criticised the opposition for alleging that the government was treating Felda settlers as slaves without caring for their welfare.


    He said that since Felda was set up 54 years ago, the settlers who did not have any land previously could now be proud and enjoy the benefits of their struggles.

    "If the people say that we purportedly enslaved the settlers, which slave can afford to own 10 acres of land? Which slave owns a brick house or a semi-brick house or at least the front wall of the house is made of bricks?



    "Fortune does not come on a silver platter, this is all because you chose the right government," said Najib, when addressing a gathering of settlers at the Felda Jengka 23 Bandar Jengka today.

    Also present were the prime minister's wife, Rosmah Mansor, Menteri Besar Adnan Yaakob, Defence Minister Ahmad Zahid Hamidi and Felda Chairman Mohd Isa Samad.

    In fact, he said, the promise made by the opposition that they intended to dispose off 300,000 hectares of Felda plantation land to be given to the second and subsequent generations of Felda settlers would bring about catastrophe to the settlers.

    "This is because 51 per cent of the investments in Felda Plantation belongs to Koperasi Pembangunan Felda with dividends being paid out at 14 percent to the settlers, which is much higher than the dividends paid out by the Employees Provident Fund (EPF) and the unit trust.

    "This dividend will no longer be available if it (the land) is given to the children and grandchildren. Actually, we have considered the interest and future of the settlers' children and grandchildren," he said.

    Islamic struggles

    The prime minister said government efforts in developing the settler community was based more on Islamic struggles rather than the struggles championed by the opposition.

    "If we want to champion the cause of Islam, what type of Islam is it going to be? Poor Muslims? Those without land? (Those) with dilapidated houses? This is not the image of Islam championed by the government. We want an image that is strong and impressive in the eyes of the world," he said.

    Meanwhile, Najib agreed to give special consideration on the payment of a Replanting Incentive Scheme to Felda settlers in the Kerdau state constituency, that is, Felda Jengka 22, 23 and 25.

    He said the matter would be discussed by the Felda management with the Malaysian Palm Oil Board (MPOB).

    At the function, Najib also opened the open air futsal pitch, Dewan Semai Bakti, broadband centre and performed the virtual ground breaking for the Felda Jengka 9 biomass factory.
