    REPORT ON BUKIT ANTARABANGSA DOES NOT COMPROMISE NATIONAL INTREST AND SECURITY

    Shah Alam: The Selangor Government believes that the people of Bukit Antarabangsa has the right to know the details of the report on the final investigations into the December 2008 landslide tragedy which had cost the lives of five of its residents. In the interest of the residents' safety, the State had through the Menteri Besar's power under Section 2C of the Official Secrets Act , declassified the report which was classified as "secrets" by the Works Ministry.

    The state is determined to have copies of the report be made available to the public and has instructed the Ampang Jaya Municipal Council (MPAJ) to make copies and sell them at cost beginning today. However following the state's announcement last week, the Federal Government has since challenged the decision and cautioned for the state not to declassify the documents instead. The state has written to the Works Ministry to inform it of the decision and requested that the ministry to do the same in the name of public interest. However, the ministry claimed that it has no jurisdiction to decide on the matter as the classification was done by the Cabinet Minister. Therefore the state has no choice but to withhold its decision to make the report public.

    We call on the federal government to allow the release of the report as its contents are crucial to public discourse to speed up the establishment of regulations for slope development in Bukit Antarabangsa and other parts of Selangor. Having been privy to the report, the state believes that it will not prejudice the national interests and security. In fact, public interest and security will benefit from the revelation of the report.

    The landslide on Dec 6, 2008 was indeed a tragedy but it will be a bigger tragedy if the Federal Government fails to be accountable and take responsible actions to protect the safety of the people. The state is committed to act in the interest of the people of Selangor and will do the necessary for that interest to be upheld.

    Selangor Menteri Besar Khalid Ibrahim is to be lauded for declassifying the investigation report over the Bukit Antarabangsa landslide tragedy under Section 2(C) of the Official Secrets Act.

    The landslide occurred in Taman Bukit Mewah, Bukit Antarabangsa on Dec 6, 2008 at 3.30am. The tragedy claimed five lives and destroyed 14 houses. The widespread media coverage of the landslide and the rescue effort then has turned the nation’s attention to hillside property development.

    The Selangor MB’s decision to declassify the investigation report shows that the Selangor Government respects the citizens’ right to information. In doing so, they have set a sterling example of transparency and good governance to the rest of government administrations in the whole country. MalaysianMirror....

The news flash that came out late yesterday from the MB office that the Selangor Government intent to defer its decision on the disclosure of the BA landslide report certainly brought a shock to a lot of residents in BA. What many do not know is the reason behind this reversal of an earlier state decision.

We must remember that the current Selangor Government is a working in a system where largely it’s top and middle management executives are people who was bred and buttered by the former regime.     KUALA LUMPUR, Nov 27 — Both the federal and Selangor governments, embroiled in a tussle over declassifying the Bukit Antarabangsa landslide report, have been reminded not to lose sight of the fact that five lives were lost in the tragedy and that victims deserve answers.

    “We are not bothered about the politics, just give us the report,” Bukit Antarabangsa action committee chairman Datuk N. Muniandy said yesterday.

    He said the victims of the Dec 6 landslide last year, which also destroyed 14 bungalows and caused million in damages, had been waiting long enough.

    Last week, the Selangor mentri besar attempted to declassify the

    Selangor Exco Members To Assume Responsibility For Landslide Report Declassification


    SHAH ALAM, Nov 30 (Bernama) -- Selangor state executive councillors have agreed to assume full responsibility for the proposed declassification of the final report on last year's landslide in Bukit Antarabangsa, Menteri Besar Tan Sri Abdul Khalid Ibrahim said Monday.

    The state executive council meeting of Nov 18 agreed to the use of the powers of the menteri besar under Section 2C of the Official Secrets Act 1972 to declassify the document because it touched on land issues under the purview of the state government, he said in a statement.

    Abdul Khalid said other officers in the state government were not involved in the decision and, as such, they could not be subjected to any legal action.

    "So, in this matter, the state government gives the assurance that it will safeguard all its officers from any legal action, if any, associated with this issue," he said.

    He also said that the state government was doing everything it could to ensure that federal government bodies gave the go-ahead to make public any report.

    Abdul Khalid said state government legal authorities were looking into several provisions to alter the status of the document should the federal government not respond to the application by the state government.

    The state government and its agency, the Ampang Jaya Municipal Council (MPAJ), had written to the Works Ministry and the Federal Cabinet seeking permission to make public the report but had not received any response so far, he said.

    The report prepared by the ministry had been reportedly sent to the Ampang Jaya Municipal Council in September and the state government was informed of this only this month, he added.

    The landslide, which occurred on Dec 6 last year, killed five people, damaged 14 bungalows and caused damage estimated at millions of ringgit.

    Cabinet buckled under pressure. This is the benefit of having a strong opposition. Increase the PR seats during the next election and BN will behave even more responsibly to the Rakyat. It's amazing how the Works Minister can spout those rubbish with a straight face. Now it's done in the public interest. The document should never have been put under the OSA in the first place. It shows how arrogant and out of touch are these UMNO leaders.

    TAMPIN - The Ampang Jaya Municipal Council (MPAJ) can now announce to the public the investigation report on the Bukit Antarabangsa landslide in December last year.

    In a Bernama report, Works Minister Shaziman Abu Mansor said the government had approved the MPAJ's request to publicise the report following the decision reached at the Cabinet meeting on Friday.

    In public interest

    "The decision was made to ensure that the interest and safety of the people in the area are safeguarded. I hope the MPAJ will not merely disclose the report but also understand and implement the recommendations made to improve the situation in the area so that the possibility of a recurrence can be reduced," he told reporters after a gotong-royong programme to repair the houses of poor families in Kampung Baru Air Kuning Selatan, near here.
