    PETALING JAYA, Jan 24 — The police have finally relented to appeals from the family of Kugan Ananthan to have a second post-mortem to determine his cause of death.

    The family of the 22-year-old suspected car thief is disputing the initial official findings which indicate he died due to water in his lungs after five days in police custody.

    Lawyer Gobind Singh Deo, who is assisting the family, said the second post-mortem will be done tomorrow at 9am at the University Malaya Medical Centre (UMMC).

    "The procedure is expected to take between eight and nine hours because the family has requested for a detailed examination of the body."

    However, he said getting police authorisation for the second post-mortem was an uphill battle despite assurance from Bukit Aman yesterday that the police would authorise it.

    Gobind, who is also Puchong MP, said police at the Subang Jaya district headquarters today initially refused to give the green light, saying that they did not receive any instructions from Bukit Aman.

    "I had to accompany the family to the police station at 3pm and had to liaise between the officer in Bukit Aman and the Subang Jaya police chief to resolve the issue."

    Despite this, the police still insisted they get an official letter from UMMC and they were forced to go to the hospital at 5pm.

    Gobind said the issue was finally resolved at about 8.30pm after a UMMC public relations officer spoke to the Subang Jaya police chief over the phone to get his green light.

    "The whole situation was ridiculous and the police should not have put the grieving family through the ordeal."


    Subang Jaya police chief ACP Zainal Rashid Abu Bakar declined to comment when called by The Malaysian Insider today.

    For six days following A Kugan's disappearance on Jan 14, his family members had sleepless nights searching for him but it was all in vain.

    "I could not sleep that night. We searched from one police station to another looking for him but everywhere we went, they said he was not there," she said.


    On Jan 20, their worst fears were realised when a patrol car pulled up in front of a relative's home in Puchong, to inform them that Kugan had died under police custody.

    Kugan is the latest victim of death while in police custody, allegedly due to assault. The police had claimed that Kugan was a suspected car thief and there was no foul play involved in his death.

    Relatives told Malaysiakini that they last saw Kugan on Jan 14 at about 7pm and never heard from him again.

    His aunt, S Renuga, 31, recalled on that evening she received an anonymous phone call informing her that Kugan had been arrested but details were sketchy.

    The outlawed Hindu Rights Action Force (Hindraf) is accusing the police and the Attorney-General of deliberately delaying investigations into the alleged murder of A Kugan, who died while in police custody.

    "Why do the police and A-G's office need three days before even classifying (the case) as murder or arresting the policemen responsible?


    ......Selangor police chief Khalid Abu Bakar caused a stir when he claimed that Kugan, 22, died due to 'fluids in the lungs' and claimed that there were no foul play.

    He courted more controversy yesterday when he urged the family to seek a court order for a second post-mortem to be performed.

    ......Meanwhile, DAP chairperson Karpal Singh has urged the authorities to charge the doctor who conducted the first post-mortem on Kugan for issuing a false report.

    Karpal, a prominent lawyer, said that the doctor could be charged under Section 197 for knowingly issuing a false post-mortem report claiming that the cause of death was due to 'fluids in the lungs'.

    ......MCA central committee member Wong Nai Chee said: "In view of public disappointment on the police's handling of this issue, it is only relevant that the IPCMC be immediately established to prevent power abuses, instill accountability and to create a police force that is respected,".

    Credibility chasm widens

    In politics, things do not happen by accident. If there is a consistent pattern in the behaviour of the police towards a certain group, we can safely assume it is official policy.

    The solution lies in changing the government and wholesale reform of the police force.


    Credibility has been a key issue in police-people relations ever since the Francis Udayappan case in 2004 and a later inquest that ruled he had died by drowning in the river behind the Brickfields police station.

    Credibility is the reason why the crowd stormed the mortuary to see Kugan’s body for themselves and do what they did – cry, hug and take photographs.

    The graphic photographs they took are now circulating on the Internet and being delivered to the inbox of hundreds of thousands of people.

    Together it all makes for another explosive political disaster for the Government
    , the latest in a long list that had alienated the poorer sections of the Indian community.

    Apart from addressing policies that marginalise the poor sections of the Indian community, the Government should also set up an independent body to investigate abuse by the rank and file in the police force.

    THE death in police custody of suspected car thief A. Kugan is only the latest in a series of cases that serves to highlight the deep distrust that exists between the rank and file of the force and the Indian working class.

    It comes in the wake of another case last week where six police personnel were charged with causing grievous hurt on a suspect, using boiling water.

    Although a minority, the Malaysian-Indian poor are blamed, rightly or wrongly, for most of the violent crimes in the country. Study after study has shown a direct correlation between crime and poverty, marginalisation and alienation and it is no surprise if Indian involvement in crime is higher compared to other communities.

    Consequently, the percentage of Indians in prison, police lock-ups and in police statistics are higher than others when compared to their population size of below 8%.

    Approval for 2nd Post-mortem given by police.

    CPO was being difficult about the choice of pathologist, the family’s wishes have prevailed.

    Their choice of pathologist will undertake the second autopsy tomorrow morning, 9am. Am told that members of the family and lawyers will be permitted to view the autopsy being done from the viewing gallery.

    Nanda informed me that it is expected the autopsy will take anything between 5-8 hours after which the pathologist will have to write up his report.

    JOHOR BARU, Jan 25 – Two deputy ministers are likely to face action if they are found to have broken the law in accompanying the crowd that raided the mortuary of Serdang Hospital in Selangor on Tuesday, Home Minister Datuk Seri Syed Hamid Albar said.

    Datuk K. Devamany and Senator T. Murugiah, both deputy ministers in the Prime Minister’s Department, were present at the morgue when the crowd entered the premises to examine the body of suspected car thief A. Kugan who had died while in police custody.

    “No minister or member of the administration is above the law and if you have committed an offence then you have to face the consequences,” Syed Hamid told reporters before attending a public forum on the Internal Security Act (ISA) here last night.

    SEPANG, Jan 25-S Manikavasagam has offered police a recording on what transpired at the Serdang Hospital on Tuesday, when a mob allegedly barged in and tampered with the body of Kugan Ananthan.

    The Kapar Member of Parliament who was summoned to provide a statement on the incident, together with lawyer N Surendran to Sepang police today, said the police were welcomed to have a copy.

    “What trespass? The recording will show that the attendant at the mortuary opened the doors for the family who went in first.”

    Manikavasagam said the group did not barge or break into the mortuary as claimed by authorities.

    “We have the proof to dispute the Government version of what transpired during the incident and we want police to charge a doctor at the hospital who made a false report over the incident.”

    The duo were questioned separately today for about 35 minutes by investigating officers.

    Tuesday’s incident came in the wake of Kugan’s death while in police custody.

    The alleged 22-year-old car thief was arrested five days earlier and recordings of his scarred and bruised body had been widely spread over the internet.

    KUALA LUMPUR, Jan 25 — Opposition Leader Datuk Seri Anwar Ibrahim today said the death of suspected car thief Kugan Ananthan in police custody should not be turned into a racial issue.

    “We must not take it as a racial issue. Just because an Indian is involved does not make it any less important,” said Anwar at a press conference here.

    “As a Malay I don’t think it is wise to defend the crime and abuse of the BN led government. We must defend the rights of all Malaysians,” he added.

    Anwar said that Pakatan Rakyat MPs would “not be silent” until the Home Minister assures Malaysians that this incident does not recur.

    The Permatang Pauh MP also urged the government to form a royal commission of enquiry to uphold the integrity of the police force.

    “I call on the government to form a royal commission to investigate the continuous crime of a small number of the police personnel, who are protected by higher ups to restore the image and credibility of the police and to protect the good name, of the majority of the police who have been serving well,” said Anwar.

    Autopsy finds external injuries on Kugan

    KUALA LUMPUR, Jan 27 – A second autopsy on suspected car thief Kugan Ananthan has found external injuries caused by blunt force trauma, sources told The Malaysian Insider.

    The 22-year-old, who died while in police custody on Jan 20, was said to have died of cardiac arrest following the injuries.

    Initial findings also revealed Kugan was asthmatic, and his condition had caused phlegm to accumulate in his lungs, the sources said.

    The full report is expected to be issued within days after Universiti Malaya Medical Centre pathologists carried out the autopsy for nearly 10 hours on Sunday following a dispute over earlier findings that he died of "water in the lungs".

    Funeral Mile 14 Puchong Hindu Burial Ground 28/01/09 Wednesday 3:45 to 4pm

    A Malaysian has died. This is a human rights issue and should be treated as such. Those who come out in support should sympathise with the family of Kugan as a fellow Malaysian. Please do not treat it as a racial issue.

    Let his death not be in vain. Lay him to rest with dignity.

    The cortege is expected to arrive at the burial ground between 3.45 - 4.00pm tomorrow.

    My friends and I will make our way to the cemetary at the 14th Mile, Puchong to pay our last respects to Kugan and to extend our condolences to his family.
